Duty of Disclosure

The Insurance Contracts Act sets out a client's Duty of Disclosure and what is required of them when disclosing their personal and medical information to an insurer before commencement of an insurance policy.

Your Duty of Disclosure still applies even after their application is submitted, so it's important that they pass on anything important that may affect their answers in their application, right up until the date their policy commences.

If you don't disclose all information to the insurance company throughout the entire application process, there is a risk that their claim may not be paid and your policy may even be avoided or varied.
